Terms and Conditions of Service

Article 1 • Acceptance of Terms & Platform Role

These Terms and Conditions of Service ("Terms") constitute a legally binding agreement between you ("User", "Traveler", "You") and PT Go Travelist Asia ("GTA", "Platform", "We", "Us"). By accessing, browsing, registering an account, or purchasing any travel listings across gotravelist.asia, you acknowledge that you have read, understood, and agreed to be bound by all provisions set forth herein.

GTA operates exclusively as an online decentralized travel directory and reservation intermediary connecting independent travelers directly with verified local ground and maritime tour operators, accommodation hosts, and verified travel content creators. GTA is not an airline, transportation carrier, hotelier, or tour operator.

Article 2 • Non-Flight Ground & Maritime Travel Scope

Platform listings, booking engines, and directory databases are strictly restricted to authentic non-flight travel sectors within the 32 recognized Asian member states across 6 geographic zones. Service offerings are strictly classified into five core pillars:

  • Experiences & Activities (EXP): Local cultural workshops, guided heritage tours, watersports, spa/wellness retreats, and attraction entry passes.
  • Tours & Packages (TUR): Day excursions, multi-day overland tours, private chartered island-hopping trips, and open guided groups.
  • Transport & Transfers (TRN): Maritime fastboat connections, ferry transfers, private chauffeured cars, and airport/pier logistics. Scheduled air transportation (commercial flights) is strictly prohibited from listing.
  • Stays & Accommodations (STY): Private villas, eco-resorts, boutique lodges, glamping sites, and traditional guesthouses.
  • Travel Creator Hub (CTR): Short vertical travel video reels and narrative travelog route journals curated directly by verified creators.

Article 3 • Direct Partner Booking & Non-Carrier Liability

When you execute a reservation on the platform, your contractual relationship for service delivery is formed strictly and directly with the designated third-party Vendor Operator ("Vendor Partner").

GTA disclaims all legal liability for acts, omissions, delays, mechanical breakdowns, itinerary adjustments, property damage, personal injury, illness, or fatalities arising out of or related to services rendered by independent local vendors. Each vendor is independently certified and responsible for maintaining mandatory commercial operating licenses, maritime seaworthiness certificates, and passenger liability insurance under their respective local laws.

Article 4 • Direct Vendor Settlement & Escrow Framework

GTA upholds a clean, zero-markup direct pricing architecture. All catalog rates reflect direct supplier pricing without predatory intermediary commissions.

Payments are remitted through direct bank transfers into verified vendor bank accounts or platform escrow accounts as instructed during the checkout workflow. Travelers must upload legible payment proof screenshots via the platform dropzone within the specified 15-minute countdown window. Failure to submit verified payment proofs within this timeframe releases the reserved inventory slot back to the public pool.

Article 5 • Free Cancellation Policy & Refund Protocols

Unless explicitly designated as "Non-Refundable" on the product detail specification, all verified listings operate under the GTA Standard 24-Hour Free Cancellation Policy:

  • Full Refund (100%): Granted if cancellation requests are transmitted through the user dashboard at least twenty-four (24) hours prior to the scheduled local activity start time or check-in hour.
  • Late Cancellations (< 24 Hours): Requests transmitted within 24 hours of scheduled execution, or traveler no-shows at designated pickup locations, are strictly non-refundable to compensate operator logistics preparation.
  • Force Majeure Weather Cancellations: If maritime authorities, harbor masters, or national parks close water channels or trails due to natural hazards, travelers are entitled to a free reschedule date or an immediate full refund arbitrated via the Master Admin Dispute Center (VIEW 14).

Article 6 • Intellectual Property & Image Protection

All trademarks, vector logos, interface styling, codebases, custom layouts, and curated editorial content on gotravelist.asia are the proprietary property of PT Go Travelist Asia and its contributing content creators.

Photography and visual materials featured in travelogs and listing galleries are protected by dynamic CSS watermark overlays reading "© Go Travelist Asia • Karya [Author]". Automated web scraping, data mining, unauthorized downloading, reproduction, or redistribution of platform media without explicit written consent is strictly prohibited and constitutes an infringement punishable under international intellectual property treaties and Indonesian Law No. 28 of 2014 on Copyright.

Article 7 • Creator Hub & Referral Attribution

Travel content creators authorized under the Travel Creator Hub publish narrative travelogs and vertical video reels. Creators may embed authorized product tags linking to verified vendor offerings.

When travelers navigate via an authorized creator link bearing the parameter ?ref=CTR-XXX, the platform records a persistent attribution token in client storage for a duration of thirty (30) calendar days. Completed and non-disputed bookings executed within this window entitle the attributed creator to a standardized referral honorarium (5% net commission) credited to their Creator Studio balance.

Article 8 • User Accounts & Conduct Rules

Travelers may explore public listings as guests or authenticate via Meta Instagram OAuth, Google GIS, or direct email credentials. You represent that all contact details provided during checkout (legal name, email, and WhatsApp telephone number in E.164 format) are true, accurate, and current.

You agree not to utilize the platform to: (a) submit fraudulent payment slips or falsified bank transfer confirmations; (b) execute speculative, fictitious, or duplicate bookings; (c) inject malicious scripts, bots, or scrapers; or (d) transmit defamatory, unlawful, or offensive remarks within discussion threads. GTA reserves the right to immediately terminate user accounts and cancel associated vouchers without notice upon breach of this clause.

Article 9 • Reviews, Ratings & Content Moderation

Travelers who have completed a verified journey are entitled to submit ratings (1 to 5 stars) and authentic feedback. All user-generated reviews, community questions, and travelog comments undergo automated and manual compliance screening prior to public indexing.

GTA retains the absolute discretion to edit, decline, or purge reviews containing hate speech, commercial advertising, extortion attempts, or private identifying details. Reviews submitted by individuals who did not complete the underlying service voucher will be deleted immediately.

Article 10 • Disclaimers of Warranties & Force Majeure

Platform services, directory content, and API connections are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.

Neither GTA nor Vendor Partners shall be held liable for failure or delay in fulfilling service obligations if such non-performance results from acts of God, volcanic eruptions, earthquakes, tsunamis, severe maritime gales, tropical cyclones, government-imposed border closures, civil unrest, strikes, internet gateway blackouts, or epidemics ("Force Majeure Events"). In such circumstances, affected bookings shall be rescheduled or refunded pursuant to Article 5.

Article 11 • Limitation of Legal Liability

To the maximum extent permitted by applicable law, in no event shall PT Go Travelist Asia, its directors, officers, employees, or tech contributors be liable for any indirect, incidental, punitive, consequential, or special damages, including loss of profits, data, enjoyment, or travel disruptions.

In all events, the total cumulative financial liability of GTA to any traveler for all claims arising out of a specific booking transaction shall be strictly capped at the total amount actually paid by the traveler to the platform for the disputed booking.

Article 12 • Governing Law & Dispute Arbitration

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the substantive laws of the Republic of Indonesia, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, that cannot be resolved amicably through the Master Admin Dispute Center (VIEW 14) within thirty (30) business days, shall be settled by final and binding arbitration administered by the Indonesian National Board of Arbitration (BANI) in Jakarta, in accordance with the BANI Arbitration Rules currently in force. The arbitration proceedings shall be conducted in the Indonesian or English language before a single arbitrator.
